What is a stake in betting? Meaning, minimum and tax in Kenya

A stake is the amount of money you risk on a single bet. Section 2 of the Gambling Control Act, 2025 defines a bet as a wager or stake of money or money's worth. Online, section 71(1) sets the lowest stake at KES 20, and since 1 July 2025 excise duty falls on deposits, not on each stake.

A stake is the money you put at risk when you place a bet. If the bet wins, the payout is worked out from the stake and the odds; if it loses, the stake is gone. Since July 2025 the stake no longer sets the base for excise duty on betting in Kenya.

What the Act says about a stake

Section 2 of the Gambling Control Act, 2025 defines a bet as "a wager or stake of money or money's worth, or any other valuable thing" on a race, game, sport, lottery or other event or contingency.

Section 73(3) lets a licensee accept a wager only when your account holds enough funds and you have approved them. Online, section 71(1) puts the smallest stake at KES 20, and section 71(2) says that figure includes a savings component set by the Authority.

How excise duty applies to a stake

Before 1 July 2025, excise duty on betting was 15% of the amount wagered or staked, as the Kenya Revenue Authority's notice on the Finance Act, 2025 shows. From that date the rate became 5% and the base moved to the amount deposited.

Section 36(b) of the Finance Act, 2026 reworded paragraph 4A of the First Schedule to the Excise Duty Act from 1 July 2026, so the base now reads "deposited for betting purposes". Section 36(c) counts money made available for betting "whether provided by a player or the operator". The operator remits the duty to KRA within 24 hours of the close of each day's transactions.

Illustrative example: one deposit, five stakes

Illustrative example: you deposit KES 1,000 and then place five stakes of KES 200 each. Excise at 5% is worked on the KES 1,000 deposit, which gives KES 50, and the five stakes are not measured again. Under the rule before 1 July 2025, each KES 200 stake would have carried 15%, or KES 30, which came to KES 150 across the five.

What a stake is not

A stake is not your balance and not a withdrawal. Section 69 says an online gambling transaction starts with a deposit and ends with a withdrawal, which has its own tax rule; see how a bet is taxed from stake to payout.

No maximum stake is set in the Act or the Regulations as gazetted. The caps that exist are the ones you choose, which licensees must offer under regulation 84 of the 2026 Conduct of Gambling Operations Regulations, explained in deposit limits and time limits in Kenyan betting law. For the wider term, see what counts as online gambling under the Act.

Questions and answers

Is the stake taxed when I bet in Kenya?

Not directly. Since 1 July 2025 excise duty on betting is 5% of the money you deposit, under paragraph 4A of the First Schedule to the Excise Duty Act, instead of 15% of each stake. From 1 July 2026 the Finance Act, 2026 describes the base as the amount deposited for betting purposes. Money you later withdraw from the account falls under a separate withholding rule.

What is the smallest stake allowed on a Kenyan betting site?

Section 71(1) of the Gambling Control Act, 2025 says a player in an online gambling activity may not bet less than twenty shillings in a competition. The KES 20 includes a savings component set by the Authority. Under section 71(3), an operator that permits a smaller online bet commits an offence carrying a fine of not less than KES 3,000,000, up to five years in prison, or both.
